Terms of Service

These terms apply to anyone who uses Marita POS: the app on maritapos.com, the Android app, and the Marita POS server and subscriptions. Marita POS is supplied by Kelvin Johnson Liwonde ("the supplier", "we"). "You" means the shop or business using it, and the people it lets use it, such as cashiers. By setting up or using Marita POS you agree to these terms.
1. Your licence to use Marita POS
We give you a personal, non-exclusive, non-transferable right to use Marita POS to run your own business, for as long as you follow these terms (and, on a paid plan, keep your subscription paid). Marita POS, its software, design, name and logo belong to the supplier. You are not buying the software; you are licensed to use it.
You may not:
- copy, sell, rent, resell, sub-license or give Marita POS to others, or offer it as your own product or service;
- change, decompile, reverse-engineer or take apart the software, or try to get around its subscription or device limits;
- use the Marita POS name or logo for your own products;
- share your shop key with anyone outside your business, or try to access another shop's data;
- use Marita POS for anything unlawful, or to overload or attack the service.
2. Free edition, trial and subscriptions
- Free edition: one device, up to 100 products, no syncing or server backups. Free of charge.
- Trial: a new subscription starts with a free trial (normally 30 days). No payment is taken during the trial.
- Subscriptions: Basic and Pro are paid monthly or yearly, at the prices shown on maritapos.com when you subscribe. Prices are in US dollars and may be paid by EcoCash, InnBucks, bank transfer or Paynow. We will give you at least 30 days' notice of any price change.
- If a subscription is not renewed: syncing keeps working for a grace period (normally 7 days), then syncing, server backups and Paynow prompts stop. Your tills keep selling and your data is not deleted; everything starts again when you renew.
- Refunds: because you can try Marita POS free first, payments for a period that has started are not refundable, unless the law requires otherwise or we agree in writing.
- Each plan has a limit on the number of devices that may sync. Using more devices needs a higher plan.
3. Your data
Your business data belongs to you: products, sales, customers, staff and reports. It is stored on your own devices, and, if you subscribe, on the Marita POS server so your tills can sync and be backed up. We use it only to provide the service: to sync, back up, restore and support your shop. We do not sell it or use it for advertising. Our Privacy Policy explains this in full.
- You can download a full backup of your data at any time (Settings → Sync & backup).
- You are responsible for your staff's PINs and your shop key, and for the information you enter, including customers' personal details, which you must handle lawfully.
- If you stop using Marita POS, ask us and we will delete your shop's data from the server.
4. Payments, tax and fiscal rules
Marita POS records payments (cash, EcoCash, InnBucks, swipe and others) but does not hold or move your money. Mobile money and card payments are made through those providers and your own accounts, under their terms; Paynow prompts are sent through your own Paynow account. You remain responsible for your shop's tax, VAT and fiscal obligations, including any ZIMRA fiscalisation requirements that apply to your business, for checking that payments were really received, and for the prices and exchange rates you enter.
5. Availability and support
We work to keep Marita POS and its server running and to fix problems quickly, and support is available on WhatsApp. Because the app works offline, your tills keep selling even if the internet or the server is unavailable. We cannot promise the service will never be interrupted or free of errors, and we may update Marita POS to improve it or fix problems. Keep regular backups.
6. Limits of our responsibility
Marita POS is provided as it is. To the extent the law allows, the supplier is not responsible for indirect losses, lost profits, or losses caused by wrong data entered, staff dishonesty, lost or stolen devices, failures of internet, mobile money, banks or other providers, or events outside our control. Where we are responsible, our total liability is limited to the subscription fees you paid in the three months before the problem. Nothing in these terms removes rights you have under Zimbabwean consumer law that cannot be excluded.
7. Ending the agreement
You can stop using Marita POS at any time. We may suspend or end a subscription that is not paid, or a shop that seriously breaks these terms (for example, copying or reselling the software), after warning you where reasonable. Sections 1, 3, 6 and 9 continue after the agreement ends.
8. Changes to these terms
We may update these terms. The date at the top shows the latest version. For important changes we will tell subscribers in advance, for example by WhatsApp or in the app. Continuing to use Marita POS after a change means you accept the new terms.
9. Law
These terms are governed by the laws of Zimbabwe, and disputes will be dealt with by the courts of Zimbabwe. We will always try to settle a problem by talking first.
